1. Who we are

FOMO (the app and this website) is made and run by VentureBox PTY LTD, a company registered in South Africa (“we”, “us”). These terms are an agreement between you and us. By creating an account or using FOMO, you agree to them. Please also read our Privacy policy, which explains how we handle your information.

2. Who can use FOMO

• You must be 18 or older, and of legal drinking age in the country where you live. We ask for your date of birth when you sign up to check this.
• One account per person. Use your real name or the name your friends call you, and don't pretend to be someone else.
• You sign in with a code sent to your email, or with Apple or Google. Keep access to that email, Apple ID or Google account secure, because anyone with it can get into your account.

3. How FOMO works

FOMO helps you plan events with your friends and remember them together. In the app you can make circles, schedule events (plans), start or join an event, shoot photos onto a shared roll, play games, post Sips (check-ins) and see places on a map.

• Events: while an event you started or joined is on, the app records the places you stop at. It doesn't record a continuous route.
• The roll: photos and videos taken during an event stay hidden until the roll develops. The people who were there review it before it posts.
• Sips are visible to your friends for 24 hours.

FOMO is new and still growing. We may add, change, pause or remove features, and sometimes things will break. We'll try to give notice of big changes.

4. Games

You can play games on an event, like pub golf, bar bingo, party games, or a game you make yourself.

• Games are for fun, not for drinking. No game asks anyone to drink, and the app won't accept rules that do. Water and soft drinks always count.
• Taking part is up to you. You can sit any hole or round out, with no penalty.
• If you write your own rules, squares or prompts, they must follow our community rules. Don't dare anyone into anything unsafe, illegal or unkind. We may remove games that break these terms.
• Scores, votes and awards are part of the game. They aren't prizes and have no value outside the app.

5. FOMO+

FOMO is free to use. FOMO+ is an optional paid subscription that adds every camera filter, 10-second videos, hosting games and making your own, and ways to personalise the app such as an accent colour, app icon, profile banner and badge. The people you go out with don't need FOMO+ to join your events or play your games.

• Price: the app shows the price and plan before you pay, for example monthly or yearly, in your local currency. There's no free trial: your plan starts as soon as you pay.
• Payment: you buy FOMO+ through the App Store or Google Play, and their terms also apply. They take the payment, so we never see your card details.
• Renewal: FOMO+ renews automatically at the end of each period unless you cancel at least 24 hours before it ends. You'll be charged the same price unless we've told you about a change first.
• Cancelling and switching: manage or cancel FOMO+ in your App Store or Google Play account settings. A cancellation or a switch between monthly and yearly takes effect when the current paid period ends, and you keep FOMO+ until then.
• After it ends: you go back to the free app: 3 filters, photos only, and joining games instead of hosting them. Your colours and icon go back to the originals. Photos and videos you already took, in any filter, stay on your events.
• Refunds are handled by Apple or Google under their refund policies. Nothing here limits your rights under the Consumer Protection Act.
• Price changes: if we change the price, we'll tell you in advance, and the new price applies from your next renewal. If you don't want to pay it, you can cancel before then.

Deleting your FOMO account doesn't cancel your subscription. Cancel FOMO+ in your app store account first.

6. Your content

Photos, videos, comments, scheduled events, Sips, game answers and anything else you post are yours. To run FOMO, you give us permission to store, process and show your content to the people you share it with, in the ways the app describes. This permission ends when you delete the content or your account, except for copies we must keep for legal or safety reasons.

Only post content you have the right to share. Don't post photos of people who've asked you not to, and respect it when someone asks you to take a photo down.

7. Community rules

FOMO is for friends. We have zero tolerance for:

• Abusive, hateful, sexual or threatening content, or harassing or bullying anyone.
• Nudity or sexual content of any kind, and anything involving people under 18.
• Sharing someone's location, address or private information without their permission.
• Using FOMO for anything illegal, including selling drugs or alcohol, or to spam or scam people.
• Pretending to be someone else, or trying to break, copy or misuse the app.

Report and block: you can report any person, photo, comment or message in the app. Reports are anonymous and we review every one within 24 hours. You can also block anyone; they aren't told. We may remove content, and suspend or delete accounts, that break these rules.

8. Drinking and safety

FOMO is about time with friends, not about drinking. The app doesn't encourage drinking, none of its games ask anyone to drink, and you can use it without drinking at all.

• Never drink and drive. Plan how you'll get home before you go out.
• Look after each other, and only share your location with people you trust.
• You're responsible for your own choices and safety when you meet people, including people you know through FOMO.
• In an emergency in South Africa, call 10111 (police) or 112 from a mobile phone.

9. Deleting your account

You can delete your account at any time in the app under Settings. This removes your profile, photos, videos, check-ins, comments and ratings for good. It doesn't cancel FOMO+, so cancel that in your app store account first. Circles you own pass to the longest-standing member. We may suspend or close your account if you break these terms or if we have to by law.

10. Liability

We work hard to keep FOMO running well, but we provide it “as is” and can't promise it will always be available or free of errors. As far as the law allows, we aren't responsible for indirect or unforeseeable losses, for what other users post or do, or for anything that happens when you meet up in person. Nothing in these terms limits rights you have under the Consumer Protection Act or other South African law that can't be excluded.

11. Changes to these terms

We may update these terms as FOMO changes. If we make a big change, we'll tell you in the app before it applies. The date at the top shows when they last changed. These terms are governed by the laws of South Africa.
